Abstract
Under Missouri common law, "a witness need not produce a document used to refresh recollection before testifying." This Note examines the development of Missouri's rule as well as the policy arguments for the Missouri and federal rules, in the context of State ex rel. Polytech, Inc. v. Voorhees,4 the recent Missouri Supreme Court case that reaffirmed Missouri's refreshed recollection rule.
